Securing Access to and Use of the Public and Utility Rights of Way
Access to and use of the Public and Utility Rights of Way can typically be established using two primary methods, Acquisition by Entitlement and Acquisition by Agreement.
Acquisition by Entitlement leverages a carriers prescriptive rights as a Regulated Telecommunications Utility, Commercial Mobile Services Provider, Cable TV and Broadband Services Provider and the protection and remedies afforded to each as a function of their Federal or State entitlements and operating authority.
Generally, Acquisition by Entitlement the most cost effective way to deploy wireless and broadband networks, although can be more time consuming and corrosive from a government and utility relations perspective.
Acquisition by Agreement is often a much faster and more effective means securing access and establishes a solid foundation and positive working relationship with the community.

Securing Access to Utility Owned Infrastructure
Regulations governing access to existing utility poles has changed significantly in recent years and vary by State as well as by the regulatory classification of the electric utilities and pole owners.
Rights governing third party access to utility owned infrastructure also vary by the regulatory entitlements held by the attaching party and their intended use of their facilities.
Permit charges, attachment fees, taxes and end user charges are also regulated by tariff or by customer contract while timetables are now being enforced on the utility pole owners as a means to monitor, manage, expedite and compel performance.
